Our team of lawyers has won a case in Arbitrazh (Commercial) court of Moscow on rescission of a contract on sale and purchase of shares in a Russian company. The contract was entered into between a Dutch company (buyer) and a Russian individual (seller). The dispute concerned the shares (99% of share capital) of a Russian company, which owns the major shipping company in Russia.
TRUBOR lawyers successfully argued that the Dutch company was duly notified about the proceedings in the Russian court. The court documents were served by sending the documents through Russian Post registered mail service. Hence, the proceedings in Russian court were finalized within a couple of months without a need to employ the mechanism of service envisaged in the Hague Convention on service 1965.
