Wining the case on invalidation of asset-stripping transactions at the appeal court level

Trubor advocates won in the corporate dispute concerned with invalidation of a series of transactions, which covered siphoning of assets in the amount of RUR 93,4 mln from our Client under interest-free loans.

Earlier the first-instance court refused to grant relief sough by our Client, because the judge found that the transactions in questions were not interrelated and did not cause any loss to our client.

The appeal court quashed the lower court judgment and granted our claim in full. The court declared the transactions (interest-free loans) to be void and ordered restitution. The court also found a series of other transactions, which on its face evidenced that the loans were repaid by way of transfer of the promissory notes of a major Russian bank, to be a sham transaction.

The case was argued at the appeal court by our advocates Kirill Trukhanov and Alexander Trushkov.
